On the 1st of July 2004, Australia’s first Bill of Rights came into force in the ACT. This issue of Hot Topics looks at the various arguments posed for and against the need for a Commonwealth Bill of Rights, and looks at the Human Rights Act 2004 as an example of how a Bill of Rights became a reality in the ACT, and how it attempts to give recognition to principles of fundamental human rights. It looks at the types of guarantees of fundamental rights that exist in other countries and what impact a Bill of Rights would have in the Australian context.
